1. Acceptance of terms

By accessing or using Dear Little Me ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms apply to all users of the Service.

2. Service description

Dear Little Me is a web application that allows parents and guardians to generate AI-assisted letters addressed to their children, store those letters, and optionally schedule delivery on a future date of their choosing. The Service is operated by Curious Head Labs.

3. Eligibility

You must be at least 13 years of age to use this Service. By using Dear Little Me, you represent that you meet this requirement. The Service is intended for parents and guardians — it is not for use by children.

4. Account registration

Access to the Service requires an account. You register with your email address and sign in via a magic link (no password). You are responsible for keeping your account secure and for all activity that occurs under your account. Notify us immediately at info@curiousheadlabs.com if you suspect unauthorised access.

5. Your content

You retain ownership of the content you submit, including letters, milestones, and photos ("Your Content"). By submitting content, you grant Curious Head Labs a limited licence to store, process, and transmit Your Content solely to provide the Service (for example, to generate your letter and deliver it at a future date).

You are solely responsible for Your Content. You represent that:

• You have the right to submit all content you provide.
• Your Content does not violate any law or infringe any third-party rights.
• Your Content does not contain harmful, defamatory, obscene, or abusive material.

We do not review or moderate content before storage. We may remove content and/or suspend accounts that violate these Terms.

6. AI-generated letters

Letters are generated using artificial intelligence (OpenAI's API). The AI may occasionally produce inaccurate, incomplete, or unexpected output. You are responsible for reviewing the generated letter before saving or delivering it. Curious Head Labs makes no guarantees about the quality, accuracy, or suitability of AI-generated content.

7. Prohibited uses

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Submit false, misleading, or fraudulent content.
• Attempt to gain unauthorised access to other users' accounts or data.
• Use automated tools (bots, scrapers, crawlers) to access the Service without permission.
• Abuse the rate limits or attempt to circumvent them.
• Resell, sublicense, or commercially exploit the Service without our written consent.

8. Time capsule delivery

The time capsule feature allows you to schedule letter delivery at a future date. While we take reasonable steps to ensure scheduled delivery, we cannot guarantee delivery in all circumstances (for example, if the Service is discontinued, the email address is unreachable, or a technical failure occurs). The Service is provided on a best-efforts basis and scheduled delivery is not guaranteed.

9. Intellectual property

All content, design, code, and materials on the Service (excluding Your Content) are owned by or licensed to Curious Head Labs and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from our materials without express written permission.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, CURIOUS HEAD LABS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, CURIOUS HEAD LABS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $10 USD.

12. Indemnification

You agree to indemnify, defend, and hold harmless Curious Head Labs and its officers, employees, and agents from any claims, losses, liabilities, damages, or expenses (including reasonable legal fees) arising out of your use of the Service or violation of these Terms.

13. Termination

We may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have violated these Terms. You may delete your account at any time by contacting us at info@curiousheadlabs.com. Upon termination, your letters will be deleted from our systems within a reasonable time, except where retention is required by law.

14. Changes to these terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

15. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
